1. Introduction
Welcome to OpenCommonsCrossing ("we," "us," or "our"). Your use of our website at opencommonscrossing.sbs and yacht charter services (collectively, the "Service") provided by OpenCommonsCrossing is subject to these Terms & Conditions ("Terms").
By reserving a yacht or utilizing our Service, you consent to adhere to these Terms. Access to the Service is not permitted if you do not accept all the terms herein.
2. Service Overview
OpenCommonsCrossing offers a range of high-end yacht charter services, which include, but are not restricted to:
- Daily yacht charters
- Evening cruises
- Company getaways
- Exclusive gatherings
- Extended charters
Our services are provided subject to availability and prevailing weather conditions. We may change or terminate our services without notice at our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter booking, you should meet the following criteria:
- Attain a minimum age of 18 years
- Supply truthful and complete booking details
- Remit the necessary deposit as outlined in the booking confirmation
- Accept all terms here within these Terms & Conditions
3.2 Confirmation
Only after we receive your payment and issue a confirmation in writing is your reservation guaranteed. We may decline service provision at our discretion.
3.3 Availability
Charter availability is contingent on vessel capacity and favorable weather conditions. We will make considerable efforts to accommodate your preferred scheduling.
4. Payment Terms
4.1 Pricing
Pricing is quoted in £ and includes relevant taxes unless stated otherwise. Prices can be amended without previous notice.
4.2 Payment Schedule
- Deposit: 50% of the overall cost of the charter, payable at time of reservation
- Balance: To be paid 48 hours prior to the start of the charter
- Additional fees (if applicable): Payable at the end of the charter
4.3 Payment Methods
Payments can be made via major credit cards, bank transfers, or certified cheques. Transactions are secured through encryption.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours to departure: Full refund minus any processing charges
- Between 24 to 72 hours before departure: Refund of 50%
- Less than 24 hours prior to departure: No refund given
5.2 Weather Cancellations
If our captain evaluates that weather conditions are unsafe, the following options will be provided:
- Reschedule the charter at no extra charge to a subsequent available date
- Issue a full refund if rescheduling is not feasible
5.3 Mechanical Issues
If there are mechanical issues with the designated vessel, we will strive to supply an appropriate substitute. Should no alternative be viable, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Adhere to all directions from the crew
- Utilize provided safety gear as needed
- Disclose any medical conditions that might impact safety
- Stay within the boundaries of the vessel's designated areas
6.2 Prohibited Items
Certain items are not allowed on board the vessel including:
- Glassware
- Forbidden substances
- Weapons or firearms
- Pets (without prior permission)
6.3 Conduct
Passengers are expected to behave respectfully. Should an individual's conduct present a danger or interfere with the enjoyment of others, we have the right to end a charter without refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is constrained to the charge paid for the charter. We are not liable for:
- Personal injuries due to a client's negligence
- Theft or damage to personal belongings
- Losses that are indirect, incidental or punitive
- Delays resulting from inclement weather or unforeseeable events out of our control
7.2 Insurance Coverage
We maintain full marine insurance for our boats and overall operation. Passengers should secure their personal insurance for travel and belongings.
7.3 Assumption of Risk
By taking part in our charter, you accept that maritime activities are inherently risky and you assume full responsibility for your own safety and effects.
8. Modifications and Itinerary Changes
We reserve the authority to alter itineraries, paths or timetables based on climatic considerations, safety needs or business prerequisites. We shall endeavor to provide equivalent alternatives.
9. Force Majeure
We are not accountable for any hold-ups, cancellations, or modifications due to events beyond our control, such as but not restricted to:
- Severe meteorological conditions
- Natural calamities
- Regulatory mandates
- Port shutdowns
- Vehicular malfunctions
10. Privacy and Data Protection
Your personal data is managed as per our Privacy Policy. Using our services signifies consent to the gathering and utilization of your details as specified in the Privacy Policy.
11. Intellectual Property
Our website content, including articles, illustrations, trademarks, and imagery is protected by intellectual property laws. Duplication, distribution, or the creation of derivative works without our express permission is prohibited.
12. Governing Law
The applicable laws of United Kingdom govern these Terms. Conflict resolution if any shall take place in the courts located in London, United Kingdom.
13. Changes to Terms
Amendments to these Terms may be made by us at any time. Such amendments will be posted online with an updated effective date. Continued use of our services after changes signals acceptance of the new Terms.
